Terms of Service

These Terms of Service ("Terms") govern your access to and use of the LearnShelf mobile application and related services (the "Service"), operated by Tokens Billionaires Club LLC ("LearnShelf," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or 16 in the European Economic Area, or the age of digital consent in your country, if higher) to use LearnShelf. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian. By using the Service, you represent that you meet these requirements.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
You agree to provide accurate information and to keep it up to date.
You may sign in using email, Google, or Apple. You are responsible for complying with the terms of any third-party sign-in provider you use.
Notify us promptly at support@tokensbillionairesclub.com if you suspect unauthorized use of your account.

3. License to Use the Service

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the LearnShelf app on devices you own or control, and to access content you have purchased, for your own personal, non-commercial learning.

4. Purchases, Entitlements, and Content Access

Purchases. Courses and ebooks are sold as one-time purchases. When you buy a product, you receive an "entitlement" that grants you access to that content through the Service.
Payment. Purchases are processed through the Apple App Store and/or Google Play. Your purchase is also subject to the applicable store's terms. We do not receive or store your payment card information.
Access, not ownership. A purchase grants you a license to access and use the content within the Service. It does not transfer ownership of the content or any intellectual property rights to you.
Offline downloads. Some content may be downloaded for offline use within the app. Downloaded content remains subject to these Terms and to your continued entitlement, and may become unavailable if your entitlement ends.
Availability. We may add, change, or remove content from the catalog. If content you have purchased is removed, we will use reasonable efforts to maintain your access, but availability may depend on rights we hold from content providers.

5. Refunds

Because purchases are processed by the Apple App Store or Google Play, refund requests are handled according to that store's refund policies. Please refer to Apple or Google for refund eligibility and procedures.

6. Acceptable Use

You agree not to:

copy, record, download (except through features we provide), redistribute, resell, publicly perform, or share purchased content with others;
circumvent, disable, or interfere with security or entitlement features, including digital access controls and signed media links;
reverse engineer, decompile, or attempt to extract source code or media except as permitted by law;
use the Service to violate any law or infringe anyone's rights; or
access the Service through automated means or in a way that disrupts or overloads it.

We may suspend or terminate access for violations of this section.

7. Intellectual Property

All content, courses, books, software, text, graphics, logos, and other materials available through the Service are owned by LearnShelf or its content providers and are protected by intellectual property laws. Except for the limited license in Section 3, no rights are granted to you.

8. Third-Party Services

The Service relies on third-party services, including Google Firebase, Google and Apple sign-in, and the Apple App Store and Google Play. Your use of those services is governed by their respective terms and privacy policies. We are not responsible for third-party services.

9. Disclaimers

The Service and all content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that content will meet your expectations or learning goals.

10. Limitation of Liability

To the maximum extent permitted by law, LearnShelf and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of or inability to use the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid to us in the 12 months before the claim or US $50.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Upon termination, your right to access the Service and downloaded content ends. Sections that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.

12. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you within the app. Your continued use of the Service after changes take effect means you accept the revised Terms.

13. Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to its conflict-of-laws rules. Any disputes will be resolved in the state or federal courts located in Pennsylvania, unless otherwise required by applicable law.
